Intellectual Property - Intellectual property

The need to protect intellectual property is not a phenomenon of the modern world, on the contrary, the protection of the personal relationship of the creator with his work was already desired since ancient times. Since the time of Hesiod, i.e. as early as the 8th century BC, authors tried to protect their works from possible plagiarism. Aristophanes, the Greek comic poet, quite often condemned the practice of many writers of the time to incorporate passages from other writers' works into their own.

Intellectual property is defined as the set of rules and rights that protect any intangible and intellectual creation, expressed in any way and form, provided that it is characterized by originality. Written or spoken texts, computer programs, databases, musical compositions, theatrical works, choreographies and pantomimes, audiovisual works, works of visual arts, architectural works, photographs, works of applied arts, illustrations, maps, etc.

Through the protection of intellectual property, the creator acquires a property and moral right over his work. The importance of these rights lies mainly in the author's ability to exploit his work economically and in a variety of ways and to have the moral authority to decide on his fate.

A special category of rights are related rights which tend to protect not the creator of the work but the performers – performing artists, producers of audio and/or visual media materials as well as broadcasters and print publishers, as long as their contribution shows creativity or technical skill.

Since the protection of intellectual property and related rights is based on territoriality and therefore the same rules do not apply around the world it is important to consult a qualified lawyer who will provide you with the necessary advice as to whether the work can be protected or not you, the type of rights you have on the work, the way they are protected and the temporal and spatial extent of their protection.
